Most terms of service are written to be skipped. These are written as the questions people would ask if they read them, with the answers underneath. They apply to your use of rubyandjuly.com and to every order you place with Ruby and July LLC. Placing an order means you accept them, together with our Shipping Policy, Return & Refund Policy, Payment Policy and Privacy Policy, which are part of these terms; where a summary here differs from one of those policies, the policy governs.

The store runs on Shopify, which provides the platform and checkout. Your contract for any purchase is with Ruby and July LLC alone; Shopify is not a party to it.
Can anyone order?
You need to be 18 or older to place an order yourself; if you're younger, a parent or legal guardian places it for you. Guest checkout is available and an account is optional. If you create one, keep your password private and tell us right away if you think someone else has used it. The details you give at checkout must be accurate and current, because we rely on them to deliver your order. We sell to individuals for personal use and may decline or limit orders that appear to be for resale.
What does the price include?
Everything. Prices are in US dollars; sales tax, where it applies, is calculated from your shipping address at checkout and shown before you confirm; shipping is free; and if your order ships from a fulfillment center outside the United States, all customs duties and import fees are paid by us. Nothing is collected on delivery.
The price that applies is the one shown when you place the order and in your confirmation email. Later changes don't affect confirmed orders. An obvious pricing error, such as a missing digit, isn't binding on us; if one affects your order, we'll contact you and you can buy at the correct price or cancel for a full refund.
How do discount codes work?
Enter them at checkout; we can't apply them afterward. One code per order unless the promotion says otherwise, and codes have no cash value. Promotions run for the period and on the terms stated with them. If you return an item bought at a discount, we refund what you actually paid, and sale items return on the same terms as anything else.
When is my order final?
Listing a product is an invitation to order, not a binding offer. When you complete checkout, you make an offer to buy. The automatic email you receive afterward confirms that we've received your order; it isn't an acceptance. The contract is formed when we send you the shipping confirmation.
Until then we may decline an order if the item is out of stock, payment can't be authorized, a price or description was obviously wrong, the address is incomplete, or we have reason to suspect fraud. If we've charged you, we refund the full amount. No confirmation within a couple of hours? Check your spam folder before contacting us.
How is payment handled?
You pay when you place the order, using any method shown at checkout; they're listed in our Payment Policy. Card details go directly to a PCI DSS-certified payment processor and never touch our systems; we don't store full card numbers and will never ask for them by email. By paying, you confirm you're entitled to use that method. If a payment is declined or reversed, we may cancel the order.
What happens between checkout and my door?
Processing and transit times are in our Shipping Policy. They're estimates based on normal operations, not guaranteed dates; carrier delays, weather and customs processing are outside our control, though we'll help trace anything that's late.
Risk of loss passes to you when the package is delivered to the address you gave us, not before. If your order arrives damaged, or doesn't arrive, tell us and we'll take it up with the carrier. If we can't ship within the stated timeframe, or within 30 days of your order where none was stated, we'll notify you and you can wait or cancel for a full refund, as the FTC Mail Order Rule requires. If a package comes back because the address you gave was wrong or incomplete, you choose reshipment or a full refund.
Can I send it back?
Yes. Our Return & Refund Policy governs; in brief:
- 30 days from delivery, any reason, sale items included
- Unworn beyond trying on, unwashed, tags attached
- No restocking fee
- Return shipping for a change-of-mind return is paid by you; for a defective, damaged or wrong item, we pay and send a prepaid label
- Refunds within 7 business days of our receiving the return, to your original payment method
- The return address is provided when you start a return and is never our business address
- Personalized items and gift cards can't be returned; this is stated on the product page before you buy
You can cancel free of charge at any time before your order ships.
What if it's defective?
Contact us within 30 days of delivery with your order number and photos. You choose a replacement or a full refund, and we cover any return shipping. Beyond that, everything we sell comes with the implied warranties of merchantability and fitness for ordinary purpose that Nevada law and the law of your state provide. These terms don't take them away; see "What are you responsible for?" below.
How accurate are the product pages?
As accurate as we can make them: photos, composition, fabric weight where we have it, garment measurements, care instructions and the occasions a piece suits. Screens differ, so colors may vary slightly, and measurements are approximate. If you're unsure about a size, ask before you order and we'll compare your measurements to the garment's. Range, prices and availability can change without notice, and we may withdraw a product or limit quantities. If we find an error in a description or price after you've ordered, we'll tell you and you can proceed or cancel for a full refund.
Who owns the content on the site?
The Ruby and July name, logo, site design, product photography, graphics and text belong to Ruby and July LLC or its licensors and are protected by copyright and trademark law. Browse and shop freely; copying, republishing, selling or commercial use of any content requires our written permission.
What if I leave a review or send you something?
You keep ownership but grant us a royalty-free, non-exclusive, perpetual right to use, edit, translate and publish it in any channel for our business purposes. You confirm it's yours, reflects your own genuine experience, and doesn't infringe anyone's rights or contain anything unlawful, offensive or malicious. Don't use a false email address or pose as someone else. We may decline to publish or remove content that doesn't meet these conditions, and we aren't obliged to keep submissions confidential or pay for them.
What can't I do on the site?
Use it to break the law, infringe anyone's rights, submit false information, spread malicious code, collect other people's personal information, send spam, phish, scrape or crawl without permission, or interfere with the site's security. Automated tools acting on someone's behalf may use the site only if they identify themselves as automated and don't bypass technical safeguards. If you materially breach these terms, we may suspend or end your access; orders already accepted will still be fulfilled.
What about links and downtime?
The site may link to websites and services run by others. We don't control them and aren't responsible for their content, security or practices; complaints about a third party's products or services go to that party. We may change, suspend or discontinue any part of the site at any time and can't guarantee uninterrupted availability. Nothing in this section affects an order we've already accepted.
What about my personal information?
Our Privacy Policy covers it, including what Shopify processes as our platform provider and your rights under Nevada law and the law of your state.
What are you responsible for?
We don't guarantee that the site will always be available or free of errors, and the site itself is provided "as is." Our total liability in connection with an order is limited to the amount you paid for it, and we aren't liable for indirect, incidental, consequential or special loss, such as lost profits or lost data.
Those limits don't apply to fraud, to personal injury caused by our negligence, to the implied warranties described under "What if it's defective?", or to any liability that can't be excluded by law. Some states don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms reduces your rights under the consumer protection laws of Nevada, including the Nevada Deceptive Trade Practices Act, of your own state, or of the United States.
What am I responsible for?
If your breach of these terms or of the law, or your infringement of a third party's rights, results in a claim against Ruby and July LLC, you agree to cover our reasonable costs of dealing with it, including reasonable attorneys' fees. We'll notify you of any such claim and give you a chance to respond before settling.
Can these terms change?
Yes, when the store or the law changes. The current version is always on this page with the date at the top, and changes don't apply to orders placed before they were published. We may assign our rights and obligations to another company provided your rights aren't reduced; you may not assign yours without our consent. If any provision is found unenforceable, the rest remain in force, and not enforcing a provision once doesn't waive it. These terms and the policies they reference are the entire agreement between you and Ruby and July LLC.
What if we disagree?
Contact us first; nearly every issue is settled by email, and we'd much rather resolve it directly than have you dispute a charge with your bank. These terms are governed by the laws of the State of Nevada and applicable federal law, without regard to conflict-of-law rules. Any dispute that can't be resolved by email will be heard in the state or federal courts located in Clark County, Nevada. That doesn't prevent you from bringing a claim in the small claims court where you live, or from relying on the consumer protection laws of your own state.
